Current Status: The Government of Canada had planned to bring a preliminary Motion to Strike out the class action. When we opposed this, they backed down. During a case management conference with Judge Crinson held on April 16, 2025, Canada’s legal counsel indicated that they may not bring a Motion to Strike at all. This is a preliminary victory.
Next Steps:
A further case management conference shall be convened by Zoom on June 26, 2025 at 10am MST at which time the parties are expected to have set up a schedule to hear the Certification Application- which may occur before year’s end.
